The short version
This summary is for convenience. The full terms below control.
- Our reports come from statistical models. They are estimates, they are sometimes wrong, and they do not predict the future.
- You make your own security, site, and business decisions. We do not give security, legal, or insurance advice.
- Do not use reports to make decisions about individual people, or in any way that discriminates.
- We may list your organization as a customer by name and logo. If you would rather we didn't, email support@crimegrade.org to arrange a custom agreement.
- Reports you buy are yours to use across your organization, with unlimited users. Credits do not expire while your account is open, and you can ask us to delete your data at any time.
- Our liability is limited to what you paid us in the past 12 months, and you are responsible for claims that arise from your own use of reports.
1. Who this agreement is with
1.1These Terms and Conditions (the “Terms”) are an agreement between CrimeGrade.org (“we”, “us”, “our”) and the organization that creates an account on, or buys from, the CrimeGrade reporting portal (the “Customer”, “you”, “your”).
1.2They govern the portal at reporting.crimegrade.org and its demonstration site at demo.crimegrade.org (together, the “Portal”), and every CrimeGrade report, safety grade, safety rating, score, ranking, rate, map, estimate, export, and other output we provide through the Portal (the “Reports”). The Portal and the Reports together are the “Service”.
1.3By creating an account, placing an order, or using the Service, you accept these Terms. If you accept them on behalf of an organization, you confirm that you are authorized to bind it, and “you” means that organization, including any parent, subsidiary, or affiliate whose people use the Service under your account.
1.4The Service is for business use only. Users must be at least 18 and must use the Service on behalf of an organization, not for personal, family, or household purposes.
1.5If you and we have signed a separate written agreement or order form for the Service, it controls where it conflicts with these Terms. Terms in your purchase orders or other documents do not apply.
2. What the Service is
2.1The Service evaluates the relative safety of geographic areas and addresses in the United States. Reports combine crime reported to law enforcement, including FBI and local police data; where shown, estimates of crime that goes unreported; population, housing, land-use, business, and visitor data; and our own statistical methods.
2.2Reports are estimates produced by our models. They are not raw government records, official statistics, or certified findings.
2.3Some scores are shown on scales used elsewhere in the industry so that you can compare them with scores you already use. Those scores are our own estimates. They are not produced by, affiliated with, endorsed by, or interchangeable with any other provider’s scores.
2.4The demonstration site uses sample locations for evaluation. Nothing on it is a purchase.
3. Our reports are models, and models are sometimes wrong
3.1Every Report is the output of a statistical model. Models simplify the world, and for any particular location a Report may be incorrect, sometimes by a wide margin.
3.2We make no claim to predict the future. Reports describe estimated patterns in past data. They do not forecast whether, when, or where a crime will occur, and they do not measure the risk to any particular person, property, or business.
3.3Known limitations include the following:
- Reported crime is incomplete. Many crimes are never reported to police, and reporting differs by place, crime type, and community. Agencies report late, partially, or not at all, and they change their systems and definitions. For example, many agencies sent no data to the FBI for 2021 while it changed reporting systems.
- Estimates of unreported crime depend on surveys and assumptions, and they are less certain than reported figures.
- Values for small areas and specific addresses are estimated from larger areas, nearby records, and other data. They are not counts of incidents at that address.
- Rates depend on what they are measured against, such as residents, households, parking spaces, or people present. Where that base is small or uncertain, for example in places with few residents and many visitors, rates can be extreme or misleading.
- Grades, scores, and rankings compare places with each other. A favorable grade does not mean an area is free of crime, and an unfavorable grade does not mean a site will be targeted.
- Estimates and guidance for a type of business, including for planned or proposed sites, describe the typical risk for a business of that type at that address. They are not a forecast for your business, which depends on your operations, hours, staffing, security measures, and many factors we do not observe.
- A Report describes the map coordinates we resolve from the address you enter. Check the location shown before you rely on a Report.
- Data is revised and our methods improve, so a Report generated later for the same address can differ. Figures in the Portal may also differ from figures on our public website, from official statistics, and from other providers, because each uses different sources, corrections, and methods.
3.4A Report reflects the data and methods in use when it was generated. We have no duty to update a Report or to tell you when the underlying data changes.
4. You make the decisions
4.1Reports are one input to your own judgment. You alone are responsible for the decisions you make or do not make using the Service, including decisions about security staffing, guards, security systems, site selection, leasing, lending, insurance, budgets, operations, and the safety of employees, customers, tenants, and visitors.
4.2The Service is not legal, insurance, security-consulting, real estate, investment, or other professional advice, and using it creates no consulting, advisory, or fiduciary relationship. For decisions about a specific site, consult qualified professionals and conduct an on-site assessment.
4.3The Service is not an emergency, alerting, or real-time monitoring service. In an emergency, call 911.
4.4Reports are prepared for you. No one else, including your employees, tenants, customers, visitors, insurers, lenders, or any person injured at a location, may rely on a Report, and no one else is a beneficiary of these Terms. If you share a Report, you are responsible for making sure its recipients understand its limitations.
5. Uses that are not allowed
You may not use the Service or any Report:
- to make or support a decision about an individual’s eligibility for credit, insurance, employment, housing, or tenancy, or for any other purpose covered by the Fair Credit Reporting Act or similar laws. We are not a consumer reporting agency, and Reports are not consumer reports;
- to discriminate against any person, or to steer, redline, or deny services to anyone, on the basis of race, color, religion, sex, national origin, disability, familial status, or any other characteristic protected by the Fair Housing Act, the Equal Credit Opportunity Act, or other law;
- to identify, profile, track, or target any individual or group, or to plan, facilitate, or commit any unlawful act;
- to present a Report as an official, government, or certified record, or to alter a Report or remove its notices while presenting it as ours;
- to publish, publicly display, or advertise Reports or their contents, including in property listings or marketing, or to resell or sublicense them, without our written permission;
- to scrape, crawl, bulk-download, or systematically extract data from the Service, to reverse engineer our models or methods, to use Reports to build or train any dataset, model, or product that you offer to others, or to build a competing product; or
- to share account access with anyone outside your organization, or to access or attempt to access another customer’s data.
You are responsible for making sure your use of the Service complies with every law that applies to you, including fair housing, fair lending, insurance, privacy, and anti-discrimination laws.
6. Your rights in Reports
6.1When you pay for a Report, we grant you a non-exclusive, non-transferable, perpetual license to use it for the internal business purposes of your organization and its affiliates. This includes combining Reports with your own data and using them in your own internal analyses and models, such as models of your own losses.
6.2You may share Reports with your attorneys, accountants, auditors, consultants, insurers, and lenders who need them to advise or serve you. If you buy a Report to advise a client, for example in a security assessment, you may also give it to that client as part of your work, and the client may use it only for its own internal purposes. In every case, recipients may use Reports only for that purpose, the Reports must keep our notices, and you are responsible for their use.
6.3We and our licensors own the Service, our models, methods, and data, and all Reports. All rights not expressly granted are reserved. CrimeGrade™ is our trademark.
6.4Your license to Reports you have paid for survives the closing of your account, unless we close it because you breached these Terms or failed to pay.
6.5If you send us suggestions or feedback, we may use them without obligation to you.
7. Your account
7.1Your organization may add as many users as it likes. Users must be your employees or contractors working on your behalf. Account administrators control who has access and what each user can do.
7.2You are responsible for all activity under your accounts and for keeping passwords secure. Tell us promptly at support@crimegrade.org if you suspect unauthorized access.
7.3You are responsible for the accuracy of the addresses and other information you submit.
8. Using your name and logo
8.1You agree that we may identify your organization as a customer by name and logo on our websites, in customer lists, and in sales and marketing materials. We will follow reasonable brand guidelines you send us.
8.2This permission does not let us state or suggest that you endorse us beyond being a customer, quote you, or publish a case study about you. Apart from the uses described in section 9, we will never disclose the locations you report on, or how you use the Service, without your separate written permission.
8.3If this is not acceptable, email support@crimegrade.org to arrange a custom agreement. Once it is in place, we will stop using your name and logo in new materials and remove them from our websites within 30 days.
9. Your information and confidentiality
9.1The addresses you submit, the Reports you buy, your notes and tags, your users’ details, and any loss or other business data you choose to share with us are your confidential information. We use them only to provide, support, secure, and bill for the Service and to comply with law. We do not sell them.
9.2We share them only with service providers that help us run the Service, such as our hosting, email, address lookup, and payment providers, under confidentiality obligations, or when the law requires it. Where the law allows, we will tell you before we disclose your information in response to a legal demand.
9.3We may use aggregated information about use of the Service that does not identify you or your locations to operate and improve it.
9.4We maintain reasonable administrative, technical, and physical safeguards, described on our Security page. No system is perfectly secure, and we will notify you of a security incident affecting your information as the law requires.
9.5Our payment processor handles payment card details, and we do not store them. Address search uses Google Maps Platform, and map data is © OpenStreetMap contributors. Those services’ own terms apply to them.
9.6Our Privacy Policy describes how we handle personal information.
9.7You may ask us at any time to delete your organization’s data, including its locations and Reports. We will delete it within 30 days, except records we must keep for legal, tax, or accounting reasons and copies in backups that are overwritten in the normal course, which stay confidential until then. On request, we will confirm the deletion in writing. Your license to copies of Reports you have already downloaded continues under section 6.
9.8If we run an evaluation with you before you buy, for example comparing our data with your own loss records, the written agreement signed for that evaluation governs the data each side provides. Do not send us another provider’s reports or scores unless your agreement with that provider allows it.
10. Orders, prices, credits, and refunds
10.1Prices are in US dollars and are shown at checkout. Each location Report uses one report credit. Volume prices apply to the Reports and credits bought in a single order. Regenerating a Report, for example after a data refresh, counts as a new Report unless we tell you otherwise. You are responsible for any applicable taxes.
10.2Prices marked as a launch special are introductory, and we may end them for new orders at any time. An organization that places an order while launch pricing is offered keeps launch prices for the Reports and credits it buys in the two years after its first order.
10.3Report credits are prepaid. They do not expire while your account is open, have no cash value, and cannot be transferred to another organization.
10.4Reports are digital and generated on request, so all sales are final. If a Report fails to generate, or is materially wrong because of an error in our processing, such as placing a correctly entered address in the wrong location, tell us within 30 days. We will regenerate or refund that Report, at our choice. This is your only remedy for a defective Report.
10.5Payments are processed by a third-party payment processor under its terms.
11. Changes
11.1We may change, add, or remove data sources, features, models, grades, and scoring methods.
11.2We may update these Terms by posting a new version with a new date, and we will notify account administrators of material changes by email or in the Portal. Changes do not reduce your rights in Reports and credits you have already paid for. If you keep using the Service after a change takes effect, you accept the updated Terms.
12. Disclaimer of warranties
THE SERVICE AND ALL REPORTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY WARRANTY OF ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ANY REPORT IS CORRECT, OR THAT USING THE SERVICE WILL PREVENT CRIME, LOSS, OR INJURY OR PRODUCE ANY PARTICULAR RESULT.
13. Limitation of liability
13.1TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INJURY TO ANY PERSON, OR ANY LOSS OF OR DAMAGE TO PROPERTY, CAUSED BY A CRIMINAL ACT OR ANY OTHER EVENT AT ANY LOCATION, OR FOR ANY DECISION THAT YOU OR ANYONE ELSE MAKES OR DOES NOT MAKE USING THE SERVICE.
13.2TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, OR DATA, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.
13.3OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM.
13.4These limits apply under every legal theory, including contract, warranty, negligence and other torts, strict liability, and misrepresentation. They are an essential part of this agreement, and our prices reflect them. Where the law does not allow a limit, it applies to the fullest extent the law allows.
14. Indemnification
You will defend, indemnify, and hold harmless us and our owners, officers, employees, contractors, and suppliers from all third-party claims, and all resulting losses, damages, fines, and costs, including reasonable attorneys’ fees, arising from or relating to:
- your use of the Service or any Report, including any decision you make or do not make using it;
- any crime, injury, loss, or damage at a location that you own, operate, manage, insure, finance, or assess;
- your sharing of any Report; or
- your breach of these Terms or violation of law.
We will tell you promptly about any such claim, let you control its defense with counsel reasonably acceptable to us, and cooperate at your expense. You may not settle a claim in a way that admits fault on our behalf or imposes obligations on us without our written consent.
15. Subpoenas, testimony, and litigation
15.1We are not obligated to provide expert testimony, depositions, declarations, records certifications, or other support in any legal proceeding. Any such support is available only under a separate written agreement at our then-current rates.
15.2If we receive a subpoena or other legal demand relating to your use of the Service, or are made a party or witness in a matter arising from it, you will reimburse our reasonable costs of responding, including attorneys’ fees and staff time at standard rates, unless the matter arises from our breach of these Terms.
15.3We may disclose information about your account and Reports when the law requires it.
16. Suspension and termination
16.1You may close your account at any time by emailing support@crimegrade.org. Unused credits are not refunded when you close your account.
16.2We may suspend or close your account for non-payment, breach of these Terms, unlawful or abusive use, or a security risk, with notice where practical.
16.3Download anything you want to keep before your account closes. We may delete your account data 90 days after closure.
16.4Sections 3, 4, 5, 6.3 to 6.5, 9, and 12 through 18 survive the end of this agreement, as do any payment obligations and your license to paid Reports under section 6.4.
17. Governing law and disputes
17.1These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law rules.
17.2Any dispute arising from or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Utah, and each party consents to their jurisdiction.
17.3EACH PARTY WAIVES ANY RIGHT TO A JURY TRIAL.
17.4Claims must be brought individually, not as a plaintiff or class member in any class or representative proceeding.
17.5Any claim against us must be brought within one year after it arises, or it is permanently barred, to the extent the law allows.
17.6If you are a federal, state, or local government entity, any provision of these Terms that the law applicable to you prohibits you from accepting, such as indemnification, choice of law or venue, a jury waiver, or a limit on the time to bring claims, applies to you only to the extent that law allows. For a US federal agency, these Terms are governed by federal law and, where federal law does not apply, by the laws of the State of Utah.
18. General
18.1We are not responsible for delays or failures caused by events beyond our reasonable control, including outages at our hosting, data, or payment providers, changes to or ends of law enforcement reporting, internet failures, cyberattacks, natural disasters, and government action.
18.2You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, reorganization, or sale of assets.
18.3These Terms, together with any signed agreement or order form described in section 1.5, are the entire agreement between us about the Service and replace any earlier proposals or understandings.
18.4If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it.
18.5We may send notices to the email addresses of your account administrators. Send notices to us at support@crimegrade.org.
18.6The parties are independent contractors. Electronic acceptance of these Terms is binding.
